Terms of Service

1. Agreement to These Terms
By creating an account or using Tempo, you agree to be bound by these Terms of Service and our Privacy Policy. If you don't agree, don't use the App.
You must be at least 13 years old to use Tempo. If you're between 13 and the age of majority in your jurisdiction, you represent that your parent or guardian has reviewed and agreed to these Terms.
2. Your Account
- You are responsible for keeping your login credentials secure and for all activity under your account.
- You agree to provide accurate, current information and to keep it updated.
- One account per person. Don't impersonate anyone else.
3. User-Generated Content (UGC)
Tempo is a community-driven service. Users contribute wait times, crowd levels, photos, and comments ("User Content"). You retain ownership of your User Content, but you grant Tempo a worldwide, non-exclusive, royalty-free license to host, display, distribute, and moderate that content as part of operating the service.
3.1 Prohibited content and behavior
You may not post, upload, or distribute any User Content that:
- Is unlawful, fraudulent, defamatory, or misleading (including fake check-ins or manufactured wait-time data).
- Harasses, threatens, bullies, or intimidates any person.
- Contains hate speech, slurs, or attacks on protected characteristics (race, ethnicity, religion, gender, sexual orientation, disability, etc.).
- Is sexually explicit, violent, or gratuitously graphic.
- Exposes another person's private information (doxxing) or content they didn't consent to share.
- Infringes anyone's intellectual property, trademark, or publicity rights.
- Contains malware, spam, phishing links, or automated activity.
- Promotes or facilitates illegal activity, self-harm, or drug/firearm sales.
- Impersonates anyone, including Tempo staff, venue owners, or other users.
3.2 Moderation and takedowns
We review all user reports of User Content and accounts within 24 hours. We may, at our sole discretion and without prior notice:
- Remove or hide any User Content that violates these Terms;
- Suspend or permanently terminate any account that violates these Terms;
- Automatically hide content that has received multiple user reports, pending human review.
3.3 Report and Block
Every user can and should use the in-app Report and Block tools. Long-press any photo, check-in, or leaderboard entry to report it or block the user who created it. Reports are submitted anonymously to our moderation team.
4. Acceptable Use
In addition to the UGC rules above, you agree not to:
- Attempt to reverse-engineer, decompile, or bypass any security mechanism in Tempo.
- Scrape or programmatically collect data from the service.
- Game the leaderboard with fake check-ins, multiple accounts, or automation.
- Interfere with the operation of the service or disrupt other users.
We enforce server-side rate limits on check-ins. Exceeding these limits, or evading them through multiple accounts or spoofed locations, is a Terms violation.
5. Premium Subscriptions (Tempo Pro)
Some features require a paid subscription. Subscriptions are managed through the App Store and auto-renew unless canceled at least 24 hours before the current period ends. You can manage or cancel your subscription in iOS Settings → Apple ID → Subscriptions.
Refunds are handled according to Apple's App Store refund policy. Tempo does not provide direct refunds.
6. Intellectual Property
Tempo, the Tempo logo, and all original content, code, and design are the property of Tempo Labs. These Terms do not grant you any rights to our trademarks or copyrighted material except the limited license to use the App as intended.
6.1 Copyright complaints (DMCA)
If you believe content in the App infringes your copyright, send a notice including: (a) identification of the copyrighted work; (b) identification of the allegedly infringing material and its location in the App; (c) your contact information; (d) a statement of good-faith belief that the use is unauthorized; (e) a statement, under penalty of perjury, that the information is accurate and you are authorized to act for the copyright owner; and (f) your physical or electronic signature — to legal@skipthewait.app with the subject "DMCA Notice." We will remove infringing content and terminate repeat infringers.
7. Disclaimers
Tempo is provided "as is" and "as available." Wait times are crowd-sourced estimates, not guarantees. We don't promise the service will be uninterrupted or error-free. Use of Tempo is at your own risk.
7.1 Venue Information & Non-Affiliation
Tempo is not affiliated with, endorsed by, or sponsored by any restaurant, bar, cafe, or other venue shown in the App unless explicitly stated. Wait times, busyness levels, and crowd reports are estimates derived from user contributions, statistical models, and third-party data. They reflect community observations and predictions — not statements of fact by Tempo or by the venue — and may be inaccurate or out of date. Venue names, hours, and details are provided by third-party data sources. Venue owners can contact hello@skipthewait.app regarding their listing.
Safety first. Never interact with the App while driving or in any situation requiring your attention. Always comply with traffic laws and venue rules.
8. Limitation of Liability
To the maximum extent permitted by law, Tempo Labs, its directors, employees, and affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the App. Our total liability for any claim is limited to the greater of $100 or the amount you paid us in the twelve months preceding the claim.
9. Indemnification
You agree to indemnify and hold Tempo Labs harmless from any claim arising out of your User Content, your use of the App, or your violation of these Terms.
10. Termination
You can stop using Tempo and delete your account at any time via Settings → Privacy → Delete Account. We can suspend or terminate your account for violating these Terms. On termination, your license to use the App ends immediately.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Binding individual arbitration. Except for the carve-outs below, any dispute, claim, or controversy arising out of or relating to these Terms or the App will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, conducted in Los Angeles County, California, or remotely by videoconference. Judgment on the award may be entered in any court of competent jurisdiction. The arbitrator — not a court — decides all questions of arbitrability.
Class action waiver. You and Tempo Labs each agree that disputes may be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative proceeding.
Carve-outs. Either party may (a) bring an individual claim in small-claims court, or (b) seek injunctive relief in court for infringement or misuse of intellectual property. Nothing in this section waives rights that cannot be waived under applicable law.
30-day opt-out. You may opt out of this arbitration agreement by emailing legal@skipthewait.app with the subject "Arbitration Opt-Out" within 30 days of first accepting these Terms, including your name and account email. Opting out does not affect any other part of these Terms.
For any dispute not subject to arbitration, the state and federal courts located in Los Angeles County, California will have exclusive jurisdiction.
11.1 Apple App Store Terms
These Terms are between you and Tempo Labs only — not with Apple Inc. Apple is not responsible for the App or its content, and has no obligation to furnish maintenance, support, or to address any claims relating to the App (including product liability, legal compliance, consumer protection, or intellectual-property claims). In the event the App fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-party list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be announced in-app before they take effect. Continuing to use Tempo after changes means you accept the updated Terms.
